BackgroundInformed consent is a key element of ethical clinical research. Addicted population may be at risk for impaired consent capacity. However, very little research has focused on their comprehension of consent forms. The aim of this study is to assess the capacity of addicted individuals to provide consent to research.Methods53 subjects with DSM-5 diagnoses of a Substance Use Disorder and 50 non psychiatric comparison subjects participated in the survey from December 2014 to March 2015. This cross-sectional study was carried out (...) at a community-based Outpatient Treatment Center and at an urban-located Health Centre in Spain. A binary judgment of capacity/incapacity was made guided by the MacArthur Competence Assessment Tool for Clinical Research and a clinical interview. Demographics and clinical characteristics were assessed by cases notes and the Mini-Mental State Examination, the Global Assessment Functional Scale and the Clinical Global Impression Scale.ResultsNPCs performed the best on the MacCAT–CR, and patients with SUD had the worst performance, particularly on the Understanding and Appreciation subscales. 32.7 % SUD people lacked research-related decisional capacity. There were no statistically significant differences between the groups in terms of capacity to consent to research.ConclusionsThe findings of our study provide evidence that a large proportion of individuals with SUD had decisional capacity for consent to research. It is therefore inappropriate to draw conclusions about capacity to make research decisions on the basis of a SUD diagnosis. In the absence of advanced cognitive impairment, acute withdrawal or intoxication, we should assume that addicted persons possess decision-making capacity. Thus, the view that people with SUD would ipso facto lose decision-making power for research consent is flawed and stigmatizing. (shrink)

This study analyzes the interests of Spanish audiences in travel magazines within the current context of press consumption. The objectives are to identify the readers' reading frequency and reasons for reading, what contents interest them, and what aspects of the photographs attract them. The methodology involves a structured questionnaire completed by a representative sample of the Spanish population (n=1000). The main results reveal a low reading frequency, great interest in practical information, preference for landscape photography (over the age of 54) (...) and nightlife photography (young people), and indifference regarding the journalistic source of the images. This paper uses a sample of 1243 international firms for the period 2013–2017 to analyse the effect that a greater presence of women in management teams has on business behaviour in relation to labour and human rights, and the mediating role of improved performance in these rights on corporate transparency. The results show that gender diversity in management teams is positively associated with performance in relation to labour and human rights, and that such a performance acts as a mediating factor (...) by fostering a higher disclosure of information regarding these issues. The findings therefore seem to indicate that the presence of women in management teams acts as a driving force for enhanced social responsibility. (shrink)

This article analyzes a panel of 550 international firms, for the period 2004 to 2010, to compare the role of female directors in family and non-family firms in promoting responsible practices. Many studies have associated the presence of women on the board with a higher degree of socially responsible commitment. However, we found that this is much less so in family firms than in non-family firms. In family firms, corporate social responsibility commitment does not vary significantly with the presence of (...) female directors, as the latter tend to behave in accordance with the family orientation toward CSR. This orientation depends on the stakeholders being addressed, with greater social responsibility shown toward external stakeholders than internal ones. (shrink)

The closure of schools as a result of COVID-19 has been a critical global incident from which to rethink how education works in all our countries. Among the many changes generated by this crisis, all teaching became mediated by digital technologies. This paper intends to analyze the activities carried out during this time through digital technologies and the conceptions of teaching and learning that they reflect. We designed a Likert-type online questionnaire to measure the frequency of teaching activities. It was (...) answered by 1,403 teachers from Spain. The proposed activities varied depending on the learning promoted, the learning outcomes, the type of assessment to which the activities were directed, and the presence of cooperative activities. The major result of this study was that teachers used reproductive activities more frequently than constructive ones. We also found that most activities were those favoring verbal and attitudinal learning. The cooperative activities were the least frequent. Finally, through a cluster analysis, we identified four teaching profiles depending on the frequency and type of digital technologies use: Passive, Active, Reproductive, and Interpretative. The variable that produced the most consistent differences was previous digital technologies use These results show that Information and Communication Technologies uses are reproductive rather than constructive, which impedes effective digital technologies integration into the curriculum so that students gain 21st-century competencies. Background In Spain, there has been great effort by lawmakers to put Advance Directives into practice since 2002. At the same time, the field of bioethics has been on the rise, a discipline that has spurred debate on the right of patients to exercise their autonomy. Despite all this, the implementation of ADs can be said to have failed in Spain, because its prevalence is very low, there is a great lack of knowledge about them and they have very little (...) impact on clinical decisions. The purpose of this article is to analyze and discuss the main reasons for the failure of ADs in Spain. Main body The main reasons why ADs have no impact on clinical practice in Spain have been fundamentally four: the training of health professionals about the end of life and AD is lacking; there has been no public process to increase awareness about AD, and therefore people know little about them; the bureaucratic procedure to document and implement ADs is excessively complex and cumbersome, creating a significant barrier to their application; in Spain, the remnants of a paternalistic medical culture continue to exist, which causes shared decision-making to be difficult. Conclusion Due to the four reasons mentioned above, AD have not been a useful tool to help honor patients’ autonomous decisions about their future care and, therefore, they have not achieved their objective. However, despite the difficulties and problems identified, it has also been observed that health care professionals and the Spanish public have a very positive view of AD. Having identified the problems which have kept AD from being successful, strategies must be developed to help improve their implementation into the future. (shrink)

Although the relationship between stereotypes and acculturation preferences has been previously studied from the majority perspective among adults, the perspective of adolescents and minority groups is understudied. This research analyzed the contribution of four stereotype dimensions to the acculturation preferences of Spanish adolescents and adolescents of Moroccan-origin, the moderating role of stereotypes in intergroup acculturation discrepancies, and the interaction of stereotypes with acculturation perceptions on acculturation preferences. A sample of 488 Spanish adolescents and 360 adolescents of Moroccan-origin living in Spain, (...) from 12 to 19 years old, reported how moral, immoral, social, and competent they perceive each other to be. Spanish adolescents reported their perception about how Moroccan youth were acculturating in terms of maintaining their original culture and adopting the host culture, and their acculturation preferences in the same dimensions. Adolescents of Moroccan-origin reported to what extent they were maintaining their original culture and adopting the host culture, their acculturation preferences, and their ethnic and national identity. Results showed that adolescents of Moroccan-origin reported more positive perceptions of Spanish youth than conversely. The perceived immorality of the outgroup was important for understanding the preferences for adopting the host culture of both groups, but in the opposite direction. The four stereotype dimensions modulated the majority-minority discrepancies in preferences for cultural adoption. An analysis of the interaction between stereotypes and perceived adoption on acculturation preferences showed that when Spanish adolescents perceived that Moroccan youth were not adopting the Spanish culture, perceived morality and sociability played a role in their preferences for adoption. The less moral and sociable Moroccans were perceived, the more preference for cultural adoption. These findings support the importance of considering stereotypes in acculturation studies of majority and minority groups, as well as the relevance of including these perceptions in interventions aimed at improving intercultural relations. El presente trabajo de investigación tiene como objeto el estudio de la legislación penal en la República de Colombia desde 1890 hasta la actualidad con la ley 599 de 2000, este último conocido como el vigente Código Penal. Lo anterior, conforme a la siguiente pregunta problémica ¿se ha dado un desarrollo oportuno de la legislación penal colombiana que otorgue soluciones fehacientes a las necesidades de una política criminal sólida desde sus inicios hasta la actualidad? Con ello, se pretende analizar las (...) diversas escuelas que han influido en los legisladores a la promulgación y tipificación de los delitos y sus penas en el marco jurídico penal colombiano. Se destaca ante todo, el análisis que a lo largo del desarrollo del ordenamiento jurídico colombiano abarca el contexto constitucional, doctrinal y jurisprudencial, los cuales, han logrado evidenciar el carácter de un óptimo “derecho penal” a lo largo del contexto histórico del país en mención. Se destaca así, la gran influencia de las Escuelas Clásica, Positivista y Finalista, que a hoy han venido a establecerse con fuerza en Colombia a lo largo de su codificación, desde 1980 hasta la actual ley 599 del año 2000. The widespread critical evidence surrounding executive compensation of listed corporations has boosted shareholder activism in recent decades. The say-on-pay (SOP) mechanism—a vote in which shareholders express their (dis)agreement with executive pay designs—is one of the corporate governance mechanisms that has led to this activism among listed firms. Merging agency and socioemotional wealth (SEW) arguments, this paper analyzes how effective SOP voting results are among listed family firms in terms of CEO compensation efficiency and equity. Using a sample of UK listed (...) firms from 2011 to 2018, our results show that SOP effectiveness is positively influenced by family ownership and is strongly moderated by family involvement in management and in governance as well as by family generation. Our findings stress the strong family effect and the ethical perceptions of family shareholders on SOP voting, showing how family participation in the firm encourages fairer and more aligned CEO compensation packages. SOP institutional and practical implications oriented to preserve shareholder value and family wealth are finally outlined. (shrink)

Actualmente existe un debate en torno a la naturaleza del sistema nobi a lo largo de la historia de Corea. Podemos encontrar historiadores que definen el sistema nobi como un sistema de esclavitud y a los nobi como esclavos, y a historiadores que prefieren definirlo como un sistema de servidumbre y a los nobi como siervos. En este artículo se expone la interpretación que el historiador estadounidense James B. Palais ofreció sobre el sistema nobi en la dinastía Joseon de Corea (...) a partir de su producción intelectual, poniendo un mayor énfasis en la interpretación ofrecida en su obra Confucian Statecraft and Korean Institutions: Yu Hyongwon and the Late Choson Dynasty, además de exponer las influencias intelectuales que motivaron esta interpretación por parte de Palais. La interpretación de Palais sobre el sistema nobi reviviría el debate en torno a la naturaleza del sistema nobi y sentaría las bases de la interpretación del sistema nobi para los futuros historiadores de Corea. Este artículo está motivado por el problema de la responsabilidad colectiva frente a las acciones cometidas por nuestros antepasados y por la pregunta acerca de la legitimidad de las demandas de perdón. Acudiendo al universo conceptual heredado de Hannah Arendt, en este texto se aboga por el ejercicio de la capacidad de juicio como detonante tanto de la demanda de perdón como de la responsabilidad colectiva. El perdón se presenta así no solo como una categoría moral sino fundamentalmente política, imprescindible (...) para reconciliarse con lo acontecido y mirar al futuro con esperanza. (shrink)

El trabajo llama la atención sobre un problema poco atendido por los filósofos contractualistas el cual puede presentarse a manera de pregunta: ¿Cuál es la posición original de los individuos que pactan un acuerdo de fundación de la sociedad civilizada? Para efectos del presente trabajo recurriré a la propuesta de contrato social en De Cive (1642) y Leviathan de Thomas Hobbes (1651). El trabajo defenderá la tesis de que el camino sugerido por Hobbes apela a un recurso que, a pesar (...) de ser presentado como de vital importancia en su teoría contractual, resulta inútil. Tal recurso es el que se refiere al pacto de sociedad. A pesar de que este paso fundamenta la vida civilizada finalmente es abandonado por el autor teniendo que recurrir a la fuerza coactiva del soberano para hacer cumplir lo prometido en el pacto. La razón es que los seres humanos son egoístas y tienden ineludiblemente a ser bribones: la fuerza coactiva del soberano tiene que corregir tales comportamientos. La conclusión que alcanzo a vislumbrar es que la mesa de negociación en la posición inicial sólo podría estar conformada por algunos individuos cautos, y, muchos bribones y tontos. Este conjunto de individuos con diferente percepción del significado del interés social justificaría el gran peso del argumento de la coacción gubernamental posterior al pacto de sociedad hobbesiano. Los argumentos tradicionales contrarios a la disponibilidad de la propia vida conservan alguna fuerza: en algunas sociedades, el intento de suicidio se considera todavía un delito y la colaboración —o complicidad— sigue siendo igualmente una conducta delictiva. No obstante, en los últimos años se ha llevado a cabo un creciente reconocimiento del llamado “derecho a una muerte digna”. De todos modos, ese derecho soporta ciertas condiciones que lo convierten, a mi entender, más en un eslogan pegadizo y engañoso que en (...) un derecho claramente consolidado y reconocido. En el presente artículo intentaré explicar diversos argumentos a favor y en contra de la libre disponibilidad de la propia vida formulados a lo largo de la historia del pensamiento occidental. Posteriormente, trataré de demostrar que la libre disposición de la propia vida encuentra demasiadas restricciones en España y que en algunas de ellas subyacen principios extraseculares impropios de una sociedad democrática, pluricultural y secular como la nuestra. I argue that, in Plato’s Laws, demotic virtues (δημόσιαι ἀρεταί, 968a2) are the virtues that non-divine beings can attain. I consider two related questions: what demotic virtues are and how they relate to divine virtue. According to my interpretation, demotic virtues are an attainable – but unreliable – type of virtue that non-divine beings can improve through knowledge. These virtues are not perfect; only divine beings possess perfect virtue. However, this does not mean that perfect virtue plays no part in (...) the ethical lives of non-divine beings. A lo largo de la historia, la filosofía ha situado gran parte del foco de su quehacer en el constructo intelectual de sistemas de pensamiento que profundizaran en el análisis del mundo. Si embargo, existe una tendencia marginal, dentro de la tradición filosófica, que apuesta por acercarse a la filosofía como una disciplina práctica. En este artículo trataremos de focalizar la investigación en dos pensadores, separados por más de dos mil años, que apostaron por situar la praxis en el epicentro (...) de la filosofía: Pirrón de Élide y Matthew Lipman. El primero dio lugar a un escepticismo donde la ejemplaridad del acto configuraba la doctrina. El segundo, Matthew Lipman, diseñó una metodología de filosofía para niños que ensalza la praxis comunitaria como eje desde el que fundamentar el aprendizaje de la filosofía. Cada uno, desde diferentes planos, el individual por parte de Pirrón y el colectivo en el caso de Lipman, han sido esenciales para poner el valor el sentido práctico de la filosofía. Introduction Currently, The nature and scope of Clinical Ethics Protocols in Madrid are not well understood.Objectives The main objective is to describe the features of ‘guideline/recommendation’ type CEPs that have been or are being developed by existing Clinical Ethics Committees in Madrid. Secondary objectives include characterisation of those CECs that have been the most prolific in reference to CEP creation and implementation and identification of any trends in future CEP development.Methods We collected CEPs produced and in process by CECs accredited (...) in the public hospitals in Madrid, Spain, from 1996 to 2008.Results CECs developed 30 CEPs, with 10 more in process. The most common topic is refusal of treatment . If CEPs addressing terminal illness, Do-Not-Resuscitate orders and advance directives are placed into a separate ‘ethical problems at the end of life’ category, this CEP subject emerges as the most common . There is a relationship between the age of the CEC and the development of CEPs . CECs now seem to be more likely to engage in CEP development.Conclusions The CECs in Madrid, Spain, have developed a significant number of CEPs and there is a trend towards continued development. The most frequent topics are ethical problems at the end of life and refusal of treatment by the patient. (shrink)

This research aims to fill a major gap in the relevant literature on small businesses in developing countries, specifically concerning the development of models to better explain economic and environmental performance as a result of environmental compliance, thus moving toward an explanation of the sustainable behavior of these businesses. Data from 186 pottery craft businesses located in three Mexican states (Oaxaca, Puebla and Tlaxcala) reveal that environmental compliance significantly influences economic and environmental performance, with the mediating role of environmental innovation, (...) confirming the Porter hypothesis in the context of small businesses in an emerging economy. Although Freud's "Project" does not contain overt formulations concerning the nature of the psychic, we think that it is possible to sketch some of its essential traits. To do so, we shall interpret the model of the mind constructed in the "Project". From this, we shall proceed to put the "Project" views on the nature of the psychic in connection with the classic mind-body problem. Our account will rest especially on a distinction we shall make between "representing", seen as an (...) intentional act, and "the representation", seen as a memorytrace. We shall also consider the behaviour of the quantitative-energetic factor in both the psychological and neuro-physiological process orders.Embora no "Projeto" freudiano não seja oferecida, de uma maneira explícita, uma conceituação a respeito do estatuto do psicológico, pensamos que é possível delinear esse estatuto e tentaremos fazê-lo com base em uma maneira de interpretar o modelo do psiquismo que é construído no texto freudiano. Isto levar-nos-á também a situar o "Projeto" em relação ao clássico problema mente-corpo. Pretendemos dar conta da tarefa proposta apoiando-nos, sobretudo, em uma distinção que estabeleceremos entre o representar, entendido como ato intencional, e a representação, entendida como traço de memória. Também contemplaremos a forma de comportamento do fator quantitativo-energético nas ordens processuais do psicológico e do neurofisiológico. (shrink)
